The Role
Responsible for managing all insurance (other than employee benefits) and safety issues that may expose the Company to litigation or insurance claims, including and not limited to identifying, evaluating, controlling and minimizing the Company’s exposure to loss or damage to physical assets, fidelity losses, and losses arising out of liability claims. Manages all automobile liability, fire, and property damage claims, including communications with claim reviews and investigations. Plans and coordinates functions and activities of the Company-wide safety pan, emergency and crisis response plan. Compiles and analyzes data to develop and recommend policies and administrative regulations regarding the Company’s property and liability insurance program and workers’ compensation. This position acts as liaison with insurance adjusters, legal counsel, and underwriters in coordinating property insurance matters. Represents the Company at meetings with representatives from a variety of agencies, insurance companies, and risk services firms; serves on a property safety committees; and interprets and applies federal and state laws, Board Policies and Company’s Administrative Rules and other regulations relative to risk management, safety, loss control, and areas of potential liability.
Responsibilities
MANAGING RISKS
- Conducts risk assessments, which involves analyzing risks as well as identifying, describing and estimating the risks affecting the District. Utilizes managerial skills to analyze alternative and treat identifiable risks with appropriate risk control and risk financing methods.
- Identifies property loss exposures and work with liability company(s) on appropriate levels of insurance coverage.
- Supervises the audit of insurance premiums and costs and distribution of costs within the District.
- Manages risk budget including ensuring expenses do not exceed budgeted allocations.
- Monitors case closing action, coordinates negotiations for settlement of claims wherein court action is not involved with claims adjuster and prepares reports for determined action.
- Prepares insurance bid specifications for the purpose of obtaining premium fees and updates on an ongoing basis.
- Reviews and evaluates insurance policies.
- Makes recommendations regarding the adjusting and settlement of liability and property claims.
- Obtains certificates of insurance to protect Company assets.
- Provides support, education and training to staff to build risk awareness.
- Assures that insurance programs follow federal, state, and local laws.
- Investigates property damage claims and losses, submits reports to the third-party claims administration and assists in property claims management. Evaluates insurance coverages’; identifies exposures and assesses liability through evaluation of claim loss statistics and trends. Provides each department with loss statements for worker’s compensation, general liability and auto losses.
- Communicates to property leadership what risk issues are and be able to provide them with a plan to minimize risk. The Risk Manager must be able to produce status reports regarding the level of risk associated with any given area of the business.
- Negotiates with insurance companies, brokers, or agencies with respect to premiums,
- terms and conditions, renewals and modifications of insurance contracts.
- Determines coverage, responsibility, compensability and if there is subrogation or safety issues for each claim.
- Manages claims to achieve quality results and expense.
SAFETY & WORKERS’ COMPENSATION
Safety
- Coordinates the Company’s employee safety program.
- Participates in the inspections and reviews of the Company’s operations and facilities for risk management provisions and recommends appropriate corrective actions.
- Assures the Company follows laws relating to safety, industrial health, environmental protection, hazard control, and loss prevention programs.
- Maintains OSHA files for all properties of the Company and posts all annual summaries at each property.
- Coordinates the preparation and analysis of all insurance claims, employee injury incidents, and OSHA reports for the purpose of ensuring the timely and accurate presentation of facts.
- Reviews, analyzes, and evaluates property safety plans and offers recommendations for improvement.
- Assists in implementing in-service training programs on health and safety (e.g. hazards, disaster preparedness, OSHA’s Hazardous Communication Standard, Employee Right-to-Know, etc.) for the purpose of reducing the incidence of accidents and meeting state and federal guidelines.
- Actively participates in the Safety Committees of each property. Provides support and direction and assumes the leadership role in reducing employee injuries.
- Takes necessary steps to ensure compliance with OSHA regulations.
Workers’ Compensation
- Investigates and analyzes accidents involving District employees injured while using Company equipment or facilities.
- Manages the process and activities of the Company’s safety programs, training, property
- insurance, claims management, vandalism and crisis response.
- Conducts annual Workers’ Compensation Sites Assessment inspections of all Company owned properties and facilities.
- Determines coverage, responsibility, compensability and if there is subrogation rights or safety issues for each claim.
- Plans and coordinates various liability and workers’ compensation insurance policies.
- Identifies, evaluates, controls and minimizes the Company’s exposure to injury of workers and workplace safety issues.
- Coordinates workers’ compensation claims investigation; investigates and resolves issues on claims.
- Manages return-to-work and light duty programs.
- Assures the Company follows laws relating to safety, industrial health, environmental protection, hazard control, and loss prevention programs.
- Resolves workers’ compensation claims for closure; works closely with insurance claims management team and attorney; attends and provides information for workers’ compensation appeals when scheduled.
- Responds to and investigates all employee-related safety issues and implements plans and programs to minimize future incidents. Oversees ongoing safety training programs.
AMERICANS WITH DISABILITIES ACT (ADA)
- Acts as advisor to Human Resources Department for Americans With Disabilities Act (ADA) job descriptions and facilities compliance.
- Coordinates all aspects of ADA matters for compliance with federal and state laws; keeps all tracking documents as required by the Department of Justice for ADA compliance.
- Conducts investigations into inquiries regarding ADA compliance status at Company owned sites.
EMERGENCY MANAGEMENT
- Develops Company-wide disaster plan and coordinates disaster preparedness exercises with outside emergency response agencies.
- Responds to Company crisis situations, including on-site crisis management, and afterhours responses.
- Responds to emergency safety events.
- Recommends changes and updates to the emergency/crisis response plans for the purpose of providing efficient utilization of Company financial resources and ensuring the safety of employees and guests.
Qualifications
- Bachelor’s degree from an accredited college or university in Public Relations, Business Administration or other related field; Master’s preferred.
- Certificates of Risk Management (CRM) preferred and/or Safety
- Associate Risk Manager (ARM) preferred.
- Occupational Safety and Health (OSHA) Certification preferred.
- A minimum of ten (10) years of increasingly responsible professional experience in risk management, liability insurance (working in an insurance or legal office dealing with claims), workers’ compensation, and background in litigation preferred.
- Experience with data research, collection and analysis techniques and the preparation of written and oral reports preferred.
- Or an equivalent combination of education and/or experience from which comparable knowledge, skills and abilities have been achieved, training or workshops in safety engineering, risk management or related fields.
