GENERAL RESPONSIBILITIES: The Judge will serve as an associate judge in the Stockbridge-Munsee Tribal Court along with the chief judge. The Judge is an independent, impartial trier of fact in formal proceedings requiring a decision on the record after the opportunity for a hearing. The Judge will preside over cases brought under the Stockbridge-Munsee Tribal Code and issue written decisions. Cases can include, but are not limited to, claims for child support, collections, family law, employment law, housing, and ordinance violations.
STANDARD QUALIFICATIONS:
All employees of Stockbridge Munsee Community must meet the following qualification:
- Must submit to and pass a pre-employment drug and health screening.
- Must be at least 18 years of age, unless otherwise stated on job description
- Must maintain an acceptable departmental attendance record
- Must be able to work weekends, nights and holidays
- Must obtain and maintain Elder/Youth License as stated on job description.
DUTIES:
- Perform judicial duties and conduct self in accordance with judicial responsibilities outlined in Section TCT.01.10 of Stockbridge-Munsee Tribal Code.
- Prepare for and preside at hearings and trials over cases properly before the Tribal Court. As necessary, conduct pre-hearing conferences and issue subpoenas.
- Issue rulings on motions and preliminary matters when appropriate.
- Issue written decisions that include findings of fact and conclusions of law that are based in the Stockbridge-Munsee Constitution, Stockbridge-Munsee Tribal Code, tribal common law, and tribal policies. Decisions are issued after consideration of the whole record and be supported by reliable and probative evidence.
- Manage caseload in a way that ensures a case is fairly and promptly decided.
- Operate consistent with the requirements for Judges and judicial process as outlined under Chapter TCT.01, Chapter TCT.02, and the Stockbridge-Munsee Tribal Court’s Rules of Procedure.
- Fill in for the chief judge when the chief judge is unavailable or the position is vacant.
- Must maintain an acceptable departmental attendance record.
- Must be reliable and prompt when reporting to work.
- Required to attend job related, in-service, meetings, and training to maintain professional and technical knowledge.
- Must adhere to tribal law and other applicable laws as well as tribal personnel policies and procedures.
- May be required to satisfactorily complete an exam or other testing requirement(s) to determine skill proficiency.
