ASSISTANT CITY SOLICITOR
PRIMARY FUNCTION
- This position provides legal advice to elected and appointed City officials, departments, boards, commissions, and agencies; represents the City and its departments and employees in litigation.
- Assists in collective bargaining and labor relations matters; handles collection matters relating to taxes and fees.
- Handles real estate transactions and economic development matters; reviews and approves contracts, bond documents and other instruments.
- Prosecutes in the Justices of the Peace Courts.
PRINCIPLE DUTIES AND RESPONSIBILITIES
- Represents the City in various legal proceedings including but not limited to, trials, appeals, mediations, and arbitrations.
Research and authors legal pleadings and briefs; drafts legislation.
- Conducts settlement negotiations.
- Plans trial and appeal strategies.
- Monitors legal cases assigned to outside counsel.
- Investigates legal complaints and alleged violations of federal, state, and local laws.
- Prosecutes violations of the City’s Code of Conduct before the City Ethics Commission.
- Prosecutes misdemeanor violations of the City’s Housing, Building, Sanitation, and Fire Codes in the Justices of the Peace Courts.
- Enforces nuisance laws through court action.
- Reviews City contracts and requests for waiver of the City Charter bidding requirements.
- Represents the City in bidding disputes.
- Serves on the Zoning Board of Adjustment; serves as legal advisor for City boards and commissions.
- Provides legal advice to fifteen (15) elected City officials, departments, boards, commissions, and agencies.
- Prepares or assists in preparing all ordinances and resolutions introduced to City Council; attends Council meetings.
- Works with the city’s Claims Manager to review claims, as needed; works with the Risk Manager to identify and manage liability risk.
- Works with other departments to provide up-to-date training and policies regarding legal matters.
EDUCATION AND EXPERIENCE REQUIREMENTS
- Must be a lawyer admitted to practice before the Supreme Court of Delaware or in another state to the extent permitted by the rules of the Supreme Court of the State of Delaware.
- Thorough knowledge of the varied areas of law which affect the City, particularly constitutional and civil rights law, administrative law, municipal corporation law, and criminal law.
- Thorough knowledge of civil and criminal procedure.
- Superior advocacy skills, including excellent oral and written communication skills and interpersonal skills.
- Ability to manage multiple projects and meet established deadlines.
- Ability to establish and maintain effective working relationships and to manage and resolve conflicts.
- Good knowledge of Microsoft Office, WordPerfect, and Lexis Nexis.
WORKING CONDITIONS AND PHYSICAL REQUIREMENTS
- Work is normally performed in a quiet office, seated at a desk utilizing a computer.
While performing the duties of this job, the employee is frequently required to sit, talk, or hear.
- Occasionally required to walk, use hands to finger, handle or feel objects, tools or controls and reach with hands and arms.
- May occasionally lift and/or move up to 25 pounds.
- Vision requirements include close vision and the ability to adjust focus.
